Probate is a court process that moves the ownership of assets from the dead person to where they’re supposed to be. For example, my father might have a will leaving everything to me, but when he passes away, his home is still in his name. I can’t sell his home, I can’t mortgage his home. I can’t do anything, because it’s in his name, not mine. Same with a bank account. If my father had a bank account in his name, I can’t just walk into the bank with a copy of his will and say, “Bank, give me the money.” They’re not going to do that. They’re going to say, “No, the account is owned by your father still.” Probate is, how do we get his home from his name into my name? How do we get his bank account from his name into my name?
