Trusts can be verbal. They can be written. In the estate planning context they’re always written. But what a trust really does is it breaks up an ownership interest in an asset into three parts, the beneficial interest or the beneficiary interest, the trustee or fiduciary interest that manages the asset, and the grantor interest, which is the person that creates the trust to begin with.
