There’s a variety of ways of avoiding probate. For most people, the most sensible, most efficient way turns out to be to use a revocable trust. Probate is how assets go from the dead person to where they’re going. But if during my lifetime, I put my assets in my revocable trust. Then they don’t have to go from the dead guy to where they’re going. They’re already where they’re going, so we avoid probate. But there are other methods too. I can own an asset jointly with rights of survivorship. It’ll pass right to the joint owner. I could have an IRA or another account that has a beneficiary designation that’s gonna pass free of probate, so there’s a variety of ways of avoiding it.
